PLANNING COMMISSION MEETING

1.         This meeting of the Planning Commission of the City of Cedar Hills, having been posted throughout the City and the press notified, was called to order at 7:03 p.m.

 

H.R. Brown was recognized as a voting member.

 

2.         Approval of Minutes from the August 24, 2006, Regular Planning Commission Meeting (7:05 p.m.)

 

C. Petersen stated that he would like to receive a paper copy of the minutes rather than have them e-mailed to him. C. Brown, C. Petersen and C. Steele did not receive the minutes from the last meeting.


MOTION: C. Steele - To table the approval of the minutes. Seconded by C. Chandler.

3.         Review/Recommendation on Wireless Telecommunication Ordinance (7:06 p.m.)


Staff Report:

See handouts. Kim Holindrake stated that this issue came up when T-Mobile was trying to co-locate on the existing tower. At that time they were unable to locate on the tower because the land was mistakenly deeded to the City rather than Lone Peak Links. At the time T-Mobile asked the City for a list of possible alternate sites. The deed has now been corrected and T-Mobile has located on the existing tower. The Council felt there should be an ordinance to direct future requests for monopoles.

Rodney Despain stated that pole height and placement, co-location, antennae array, and visual aspects in residential areas are areas to be considered. The City cannot prohibit the towers but can limit them and come up with reasonable standards. He suggested that any ordinance address the perceived negative effects of the monopole as it pertains to residential dwellings. The school district welcomes monopoles on school sites because it is an extra source of revenue.


Commission Discussion:

          C. Petersen is not pleased with this ordinance. It appears that it attempts to give the City business. He said that he would like to see the towers on the hillside by the water tank. He would like the ordinance to address existing towers as well. He feels the ordinance needs to address all wireless communication devices, including wireless internet antennae.

          

C. Steele has worked on a similar ordinance in another City. He feels the ordinance should address placement, height, etc. He would like the monopole to be a conditional use, which would require a Public Hearing.

          C. Brown said that he has been approached by several providers to install a tower on his roof. This proposal does not permit rooftop mounts.

          C. Steele and Rodney Despain will work on this ordinance.


MOTION: C. Chandler - To have C. Steele work on this ordinance and send any recommendations to Rodney Despain. Seconded by C. Brown.

4.         Review General Plan (7:56 p.m.)

 

See handouts. C. Brown disclosed that he has bias in regards to the open space included in the golf course and he has made an offer to buy the golf course.


The Planning Commission made the following changes to the General Plan:

          Replace the annexation plan map.

          Change all references of “town” to “City”

          Change all references of “Zoning Ordinance” to “Land Use Ordinance”

          Delete the last sentence of the first paragraph on Page 21.

          Rodney Despain will revise the second paragraph on Page 21.

          Delete the last sentence of paragraph III. 1. on Page 21.

          Delete number 8 “Agricultural Protection” on Page 23.

          Remove the word “intends” in the first sentence of the second paragraph on Page 23.


The Planning Commission requested the following:

          A zone map without color.

          An updated Parks, Trails and Open Space map with differentiation between natural open space and developed open space. Another distinction to be included is desired open space.


MOTION: C. Chandler - To reserve reviewing Chapter 1 until our next meeting in October. Seconded by C. Steele.

 

C. Petersen would like Chapter 2 included in the next agenda.

5.         Committee Assignments and Reports (9:23 p.m.)

 

Neither C. Kroes nor C. Volden attended the last Parks and Trails meeting. The Parks and Trails Committee will review their section of the General Plan at their next meeting.

 

6.         This meeting was adjourned at 9:25 p.m. on a motion by C. Chandler, seconded by C. Brown and unanimously approved.
