PLANNING COMMISSION MEETING

1.         This Special meeting of the Planning Commission of the City of Cedar Hills, having been posted throughout the City and the press notified, was called to order at 7:03 p.m. by C. Kroes.

SCHEDULED ITEMS

2.         Review/Recommendation on File Subdivision Plat for the Commercial Property Located Approximately 10000 North (Cedar Hills Drive) Between 4800 and 4600 West

See handouts. This was reviewed at the last meeting, but it was not noticed as a final. The City Council reviewed the preliminary plans and has given preliminary approval. No amendments have been made since the preliminary approval.

Roy Williams stated that the easement, covenant, restriction document is still being negotiated with Wal-Mart. The hope is to have this approved, subject to the easement document. This guarantees that there is travel across the lots and maintenance and utility easements that cross over various lots. The subdivision plat and the easement agreement would be recorded at closing. Wal-Mart is planning to own the 14 acres, not lease.

Greg Robinson stated that he has spoken to Roy Williams and the Wal-Mart representatives, including Shell MacPherson and John Owens (Commerce CRG). They are in agreement that it would be premature to record these documents until Wal-Mart owns the property. The sale will take place once the final approval has been granted.

David Bunker has reviewed the plans and documents and finds them acceptable. The plans show the 94' right-of-way.

MOTION: C. Chandler - To recommend approval of the final subdivision plat for the commercial property located at approximately 10000 North (Cedar Hills Drive) between 4800 and 4600 West, subject to recording of the CC&R’s, which include the easement agreements. Seconded by C. Gleason.

Further discussion - The subdivision plat would not be able to be recorded until the documents are recorded. This will be approved for recording only after these documents are done.
