PLANNING COMMISSION MEETING

1.         This meeting of the Planning Commission of the City of Cedar Hills, having been posted throughout the City and the press notified was called to order at 7:15 p.m. by C. Kroes.

2.         Approval of Minutes from the April 26, 2007, Regular Planning Commission Meeting (7:15 p.m.)


MOTION: C. Chandler - To approve the minutes from the April 26, 2007, Regular Planning Commission Meeting. Seconded by C. Clement.

3.         Review/Recommendation on Wireless Telecommunication Ordinance (7:19 p.m.)


Staff Report:

See handouts. Greg Robinson stated that the changes the Planning Commission suggested were made in this draft.


Commission Discussion:

            The Commission would like to see the following changes:

          2.2.1 - A wireless telecommunication facility that conforms to the development standards shall be a conditional use in any zone.

          Item 6.13.2 needs to be renumbered as 4.13.2

          1.5.3 heading changed to Residential Rooftop Antennas and add “internet service” to the list.

          4.12.3, last few words changed from “essentially no visual impact” to “as little visual impact as possible.”

 

          Strike 4.13.3.

          2.2.1.1 - Stealth design is preferred. Strike the rest of the sentence.

          3.2 - The application, site plan, and conditional use shall be . . .

          4.1, last sentence - strike “as permitted”

          C. Brown stated that it seems discriminatory to limit tower sites to publicly owned property. Alpine and Highland do not allow towers on private sites. American Fork does, but there are more restrictions than those placed on public property.

          C. Kroes said that the statement of priority for site locations is not strong. There is no language that explicitly prohibits a private site. Rodney Despain said the restrictions on locations need to be reasonable.

          The application process is not clearly defined. Greg Robinson said that the City Code can then be amended to include a section on the approval process. This ordinance will then be amended to refer specifically to that section of the Code.


MOTION: C. Clement - To recommend approval of the wireless telecommunications ordinance with: 1) The changes made by staff and in addition 2) Change the heading of Section 1.5.3 from “Satellite” to “Residential Rooftop Antennas”; 3) Add “internet service” after “multi-channel, multi-point distribution services” in the same section; 4) In section 2.2.1, first sentence, change “permitted use” to “conditional use”; 5) Section 2.2.1.1, strike, “however, monopole will be considered on a case by case location on designated City-owned property” on the first sentence; 6) Section 3.2, strike “and” between application and site plan in the first sentence, and add “and conditional use and site plan in the first sentence; 7) Section 4.1, strike “as permitted” from the third sentence; 8) Section 4.12.3, change “essentially no visual impact” in the last sentence to “as little visual impact as possible”; 9) Strike section 4.13.3; and 10) Review the section numbering to make sure all the section numbers are accurate. Seconded by C. Brown.

4.         Review Possible Motor Vehicle Use Ordinance (8:25 p.m.)

Commission Discussion:

C. Kroes said that there is not overwhelming support on the Council for this ordinance. Pleasant Grove and Lindon have similar ordinances. This item was requested by Councilman Joel Wright to address use of motorized off-road vehicles on public land. State Code leaves it up to cities to restrict or allow motorized vehicles on public land. Motorized vehicles are illegal on BLM land. It is a trespassing issue on private property. The City owns portions of the trail, other portions are privately owned. After the trail is paved, the City can better regulate motorized vehicle usage.


MOTION: C. Brown - That we consider this proposed ordinance to be unconstitutional, that we don’t have the authority to vote on it, and that we permanently dismiss it as it’s written. No second. Motion dies.


Staff Report:

          Rodney Despain stated that he does not feel this is a zoning matter. It is outside the realm of the Zoning Ordinance.


MOTION: C. Chandler - To recommend to the City Council that this draft ordinance be denied. Seconded by C. Clement.

6.         Committee Assignments and Reports (9:44 p.m.)

 

          C. Chandler: The Parks and Trails Committee met. The signs have been installed at the frisbee golf course at Heritage Park. The Doral Park tables and benches have been installed. The Parks and Trails Committee is updating its portion of the General Plan. They are looking at installing tot lots on the small parks. Councilwoman Bowman is looking at having money earmarked for Mesquite Park into Canyon Heights Park. Highland Homes is trying to deed the landslide site to the HOA, which will then approach the City to help create a park on that site. There will be no further improvements this year of the Bonneville Shoreline Trail because paperwork for the grant was late.

          Greg Robinson: UDOT is in the process of expanding/reconfiguring SR-92. They are planning on making the turn from SR-92 to Canyon Road the main thoroughfare rather than have the main route be up the canyon. The City has requested some design proposals for the trails.
